BIODATA OF  HON’BLE FORMER CHIEF JUSTICE SHRI S.R. NAYAK

The Hon'ble Shri Justice S.R. NAYAK  assumed charge of the office of the Hon’ble the Chief Justice of High Court of Chhattisgarh at Bilaspur on 17th Nov,2005

THE HON’BLE   SRI  JUSTICE  S.R. NAYAK  born on 1st January, 1945 in Naadumaskeri village of Uttara Kannada District of Karnataka State in an agriculturists and freedom fighters’ family.  Both his parents late Smt. Nagamma Rama Nayak and late Sri Rama Ranga Nayak were imprisoned by the British Government for having participated in Quit India Movement, a part of Freedom Struggle, but they refused to apply and receive Freedom Fighters’ Pension after Independence feeling that if they receive pension, that would lower the quality of their sacrifice offered to the mother land.   He did his primary education in his native place; High School Education in Janata Vidyalaya.  Dandeli of Uttara Kannada District.  He did his B.Sc. degree in Natural Sciences in Yuvaraja College, a University College of Mysore University.  He did his LL.B., and LL.M., (Administrative Law and Industrial Law) in Bangalore University.  His performance in industrial and Labour law in LL.M. Degree Course still remains a record of excellence.  Throughout his educational career, he secured ranks, medals and merit scholarships both from the Government of India, State Government, Rotary Club and concerned Universities and private foundations.

He was enrolled as an advocate on 01.03.1974.  He practiced Law as a junior colleague in the office of Late Sri M.Gopala Krishna Shetty and  later in the Law Chambers of Prof. L.G.Havanur, Senior Advocate and former Minister of Law  & Parliamentary Affairs, Social Welfare and the Chairman of the Karnataka State First Backward Class Commission.  Justice Nayak mainly practiced in the High Court of Karnataka till his elevation to the Bench on 25.02.1994.   He worked as Government Advocate in charge of Legal Aid Clinic; as High  Court Government  Advocate in-charge of Land Reforms, Revenue, Excise, Forest and Mines and Geology, Industries and Finance, Home, Services till his elevation.   He was Legal Advisor and Standing Counsel of several Public Corporations,  Universities, Boards and several other industries, social organizations, educational and charitable institutions.

He was also a part-time Professor of Law from 1975 till he was elevated and taught subjects of “Jurisprudence and Legal Theories, Industrial Law and Labour Law, Constitutional Law, Administrative Law and Law of Contracts” in B.M.S. Collage of Law and S.L.S.R.C. Havanur College of Law.   He was the Member and Chairman of the Board of Law Examinations and visiting professor in Bangalore University and outside Universities.  He was the Director-Secretary of the well-known Socio-Legal Services and Research Centre (Registered), Bangalore from 1981 till his elevation to the Bench.

He was/is associated with many educational, cultural, social and spiritual organizations and institutions.  He was also member of the Executive Council of the Advocates Association for a term.    He was the Ex-officio President of the GPF Employees of  Karnataka Region before his elevation to the Bench.

He was elevated as a Judge of High Court of Karnataka on 24.02.1994 and subsequently he was transferred as a Judge of High Court of Andhra Pradesh and he was sworn in as Judge of High Court of Andhra Pradesh on 21.03.1994.  He was re-transferred to Karnataka High Court and he was sworn in as a Judge of Karnataka High Court on 02.01.2003. He was the acting Chief Justice of Karnataka High Court from 20.10.2004 to 19.11.2004.

He is a well-known Sportsman and represented Kabaddi Team of the University of Mysore and that of the State of Karnataka at the Inter-State  Level Competitions  apart from representing the College Teams in Cricket, Volley Ball.

Justice S.R.Nayak participated in several national and international conferences, contributed large number of articles on various topics in law, ethics, sociology and political events.   He has delivered number of Endowment Lecturers, Extension Lecturers at various Universities and Foundations.   Justice Nayak served as the Governor of Andhra Pradesh Judicial Academy from 1997 and later served as the President of the Andra Pradesh Judicial Academy with effect from 13.09.2001 till his transfer to Karnataka High Court and he was instrumental in revitalizing the administration and the functioning of the Academy and he helped to build it up into a well-known Institution of refute for training and continued education for judicial officers, both at national and international levels.

Justice S.R. Nayak’s contribution to the field of law is well-known to the fraternity of Lawyers and Judges and there is no need to dilate on it.    He has handed down remarkable and sign-post opinions in various branches of law.  In the long series of judgments of Justice S.R.Nayak there is a remarkable amount   of good and they bear the impress and testimony of a great judge – quick in perception, broad in vision and fresh and enduring in approach.   The enduring currency of Justice Nayak is that of first principles, legal and economic theories and jurisprudence, and he likes to rest his opinions on them.   His attempt always is to illumine justice and humanize the law with a touch of judicious compassion and balancing societal interests with the liberties of individuals.  His burning desire is to do real justice and in achieving that he brushes aside the form at the expense of the substance.   In decision-making, Justice Nayak  goes straight to reach jugular vein of every matter which comes before him.  His concern for, respect to and treatment of companion junior judges is astounding and laudable and it is said that every Junior Judge who sat with him on the Bench craved for sitting with him again and again.

The man in Justice S.R.Nayak is as great as the Judge, if not more.   Every one who has gone nearer to Justice Nayak knows the purity of his soul and the sweetness and strength of his character.  Sweetness in him brought him large number of friends and well-wishers from all walks of life;   but, strength of his character, it is believed, makes his adversaries, nervous and panic thereby   generating tirades and unfounded allegations against him.  The weakness of Justice S.R. Nayak is that the trickster, rich or poor, could obtain no aid or comfort from him.  It is felt by his friends that Justice S.R.Nayak fails in any struggle where scrupulous integrity, candor and fine sense of what is right may be handicap.  Many have found his mental ability tough and remarkable and enduring even in worst and challenging situations.  His friends know that the beauty of his character, unassuming disposition, flairs of a child, his totally democratic and transparent way of dealings without claiming to be democrat, practising purity  in every conceivable action without claiming to be puritan, his selfless and silent devotion to work and achievement of results without high-sounding bragging and propaganda, his unfailing support and encouragement at his peril to the worthies or those who are subjected to injustice his compassion to the needy and the wronged, and may it be added, his love for his friends and his perfect charity to all men and women are far more remarkable and inculcative.   Justice Nayak never withheld honours and recognition to any person because of his creed, race, religion or caste or the proximity of the person with him, the need of love or praise which he has earned.   In his heart there is love so great that it excludes all other feelings.  Though he seems to be shy and retiring at times, he finds his greatest happiness in intercourse with men and women whom he likes.   His academic interests are extraordinary and abiding.  According to some, in him we find more of a Professor than of a Judge.   Another unique quality in Justice Nayak is that he seldom speaks about philosophy and ethics, but any keen observer will see that Justice Nayak knows enough philosophy to find that he can do without it.

Justice S.R.Nayak, his wife and children are deeply spiritual and they are blessed by the Great Living seer SRI SRI SRI SADANANDA  MAHARAJ .

He has married Smt. Shalini and they are blessed with two children, a son by name Rahul and a daughter by name Nisha.  Son is a medical doctor presently doing  post-graduation in surgery whereas daughter is a practicing Advocate and both of them have had excellent academic record.

The following account given about His Lordship in a felicitation  by  the Bar Association of the Andhra Pradesh State on the eve of his retransfer to Karnataka High Court aptly   sums up the contribution of Sri Justice S.R.Nayak to the administration of justice and development of law and his services to the society particularly to the suppressed, depressed and downtrodden classes of the people.

“………As an outstanding orator, great thinker, forceful crusader, prolific writer, constructive, progressive and dynamic jurist, Lord Justice NAYAK, an independent judge of eminence earns respect and admiration of one and all wherever His Lordship is, and he is such as Judge widely known even outside the States of Andhra Pradesh and Karnataka and in fact throughout the country.   Gifted with rare qualities of phenomenal memory, sharp intellect, clear analytical mind, fairness to do justice, Justice S.R.NAYAK inspires many law students, lawyers, jurists and judges…………………  From the vigorous pen of His Lordship, we have many outstanding and landmark judgments in all branches of Law.  From His Lordship’s pen, more than three thousand five hundred reported judgments in  all branches  of  law  except  criminal  law  have  been handed down………………. and  all  those  rulings  are the real rulers in our day-to-day administration of justice.
Erudition coupled with a honest missionary zeal for the cause of social upliftment of the suppressed and depressed sections of the society makes  him live not only in the books of Law, but also in the hearts of the people.   Identifying completely with the welfare and well-being of the people of this sacred land Justice S.R.NAYAK  is a beloved son of the Goddess Justice and Divine Mother SARASWATHI.
